The Secretary of State for Transport, being a Minister designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to the international carriage of passengers by road, in exercise of the powers conferred by that section and, with the consent of the Treasury, in exercise of the powers conferred by section 56(1) of the Finance Act 1973[3] and of all other powers enabling him in that behalf, hereby makes the following Regulations: -

These Regulations may be cited as the Road Transport (International Passenger Services) (Amendment) Regulations 2003 and shall come into force on 19th May 2003.

- (1) Regulation 14 of the Road Transport (International Passenger Services) Regulations 1984[4] shall be amended in accordance with the following provisions of this regulation.
(2) In paragraph (3) the words "shuttle service authorisation, a regular, or" and the comma after "special regular" shall be deleted.
(3) After paragraph (3) the following paragraph shall be inserted -
"
(3A) An applicant for a shuttle service authorisation or a regular service authorisation shall pay, when the application is made, a fee of £144.20 in respect of the application.".
(4) After paragraph (5) the following paragraph shall be inserted -
"
(5A) An applicant for an own account certificate shall pay, when the application is made, a fee of £5 in respect of each year of validity of the certificate.".
(5) At the end of paragraph (6), after "517/72", there shall be added -
"
and "own-account certificate" means a certificate issued in respect of an own-account road transport operation under Regulation (EEC) No. 684/92 of the Commission of 16th March 1992 on common rules for the international carriage of passengers by coach and bus[5] as amended by Regulation (EC) No. 11/98 of the Council of 11th December 1997[6]".

EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations amend the Road Transport (International Passenger Services) Regulations 1984. They provide that -
(a) the fee for a shuttle service authorisation or a regular service authorisation is increased from £140 to £144.20; and
(b) a new fee is introduced for an own-account certificate, at the rate of £5 for each year of validity.
An own-account certificate is a certificate issued in accordance with the Common Rules for the International Carriage of Passengers by Coach and Bus (Regulation (EEC) 684/92 as amended by (EC) 11/98) to non-profit making bodies, such as schools, local authorities and scout clubs, for their own transport.
Other fees payable under the 1984 Regulations are unchanged. The fees were last changed in 1990.
