EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations amend the British Nationality (Dependent Territories) Regulations 1982.
These Regulations amend paragraphs 18 and 19 of Schedule 2 to the 1982 Regulations (which stipulate what information an application for registration as a British overseas territories citizen under section 22 of the British Nationality Act 1981 shall contain) to reflect the changes made by section 5 of the Nationality, Immigration and Asylum Act 2002 (c.41).
Regulations 10 to 13 (which relate to deprivation of citizenship) are revoked to reflect the changes introduced by section 4 of the Nationality, Immigration and Asylum Act ( c.41) which substitutes a new section 40 and 40A into British Nationality Act 1981 and comes into force on the 1st April 2003. Sole provision is now made for the giving of notice where it is proposed to deprive a person of a citizenship status and the subsequent cancellation of any registration or naturalisation by the British Nationality (General) Regulations 2003. References to the time limit for applying for an inquiry are also deleted because the inquiry procedure is replaced by a right of appeal by section 4 of the Nationality, Immigration and Asylum Act 2002.
Paragraphs 12 to 17 of Schedule 2 to the Regulations are revoked because they provide for the content of applications for citizenship under provisions of the British Nationality Act 1981 which have been repealed by section 15 of and Schedule 2 to, the Nationality, Immigration and Asylum Act 2002.
