The Secretary of State, in exercise of the powers conferred on him by section 287(1) of the Proceeds of Crime Act 2002[1] and after consultation with the Scottish Ministers, hereby makes the following Order:
1.
This Order may be cited as the Proceeds of Crime Act 2002 (Financial Threshold for Civil Recovery) Order 2003 and shall come into force on 24th February 2003.
2.
The amount specified for the purposes of section 287 of the Proceeds of Crime Act 2002 is £10,000.

EXPLANATORY NOTE
(This note is not part of the Order)
This Order specifies the financial threshold for the purposes of section 287 of the Proceeds of Crime Act 2002. Under section 287, the enforcement authority (ie the Director or the Scottish Ministers) cannot start proceedings for a recovery order under Part 5 unless the authority reasonably believes that the value of the property which is to be the subject of the recovery order is not less than the specified amount.
