In exercise of the powers conferred on the Secretary of State by sections 485, 489 and 569(4) and (5) of the Education Act 1996[
1] the Secretary of State for Education and Skills hereby makes the following Regulations:
Citation, commencement and interpretation
1.
- (1) These Regulations may be cited as the Education (Grants etc.) (Dance and Drama) (England) (Amendment) Regulations 2002 and shall come into force on 1st September 2002.
(2) In these Regulations "the principal Regulations" means the Education (Grants etc.) (Dance and Drama) (England) Regulations 2001[
2].
Amendment of principal Regulations
2.
The principal Regulations shall be amended as follows.

In regulation 3(1) after "student" (in the second place where that word occurs) there shall be inserted "of a description mentioned in Part II of Schedule 1".

In regulation 7 -
(a) in paragraph (2)(a) and (b) before "the amount" there shall be inserted "such amount as the Secretary of State may determine, being not less than"; and
(b) in paragraph (4)(a) for "£1,075" there shall be substituted "£1,100".

In Schedule 1 -
(a) in paragraph 1 at the end there shall be inserted -
"
"the Switzerland Agreement" means the Agreement between the European Community and its Member States of the one part and the Swiss Confederation of the other on the Free Movement of Persons signed at Luxembourg on 21st June 1999[3] and which came into force on 1st June 2002;
(b) in paragraphs 2 and 10(b) and (c) after "the European Economic Area" there shall be inserted "or Switzerland";
(c) in paragraph 6(a) after "Article 7(2) or (3) of the Council Regulation" there shall be inserted "or Article 9(2) or (3) of Annex I to the Switzerland Agreement";
(d) in paragraph 8(1)(a) after "Article 12 of the Council Regulations" there shall be inserted "or Article 3(6) of Annex I to the Switzerland Agreement"."
6.
For Schedule 2 there shall be substituted the following Schedule -

The amendments specified in regulations 4 and 6 shall not have effect in relation to the payment of any grant in respect of the academic year ending on 31st August 2002.

EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations amend the Education (Grants etc.) (Dance and Drama) (England) Regulations 2001.
Regulation 3 corrects a drafting error in regulation 3 of the principal Regulations.
Regulation 4 amends regulation 7 of the principal Regulations to provide that the rate of grant payable per award student shown in Schedule 2 is a minimum rate and to provide that the maximum fee which may be charged to an award student is increased from £1,075 to £1,100.
Regulation 5 amends Schedule 1 to treat Swiss Nationals and certain persons related to them on the same basis as EEA nationals. This gives effect to the Agreement between the European Community and its member states of the one part and the Swiss Confederation of the other part on the Free Movement of Persons, signed at Luxembourg on 21st June 1999 (Cmnd 4904) and which came into force on 1st June 2002.
Regulation 6 substitutes a new Schedule 2 containing increased minimum rates of grant payable per award student.
