The Secretary of State for Transport being a Minister designated[
1] for the purposes of section 2(2) of the European Communities Act 1972[
2] ("the Act") in relation to any type approval scheme for agricultural or forestry tractors and their components, in exercise of the powers conferred upon him by section 2(2) of that Act, hereby makes the following Regulations:
Citation and commencement
1.
These Regulations may be cited as the Agricultural or Forestry Tractors and Tractor Components (Type Approval) (Amendment) Regulations 2002 and shall come into force on 12th August 2002.
Amendment of the Agricultural or Forestry Tractors and Tractor Components (Type Approval) Regulations 1988

- (1) The Agricultural or Forestry Tractors and Tractor Components (Type Approval) Regulations 1988[
3] shall be further amended as follows.
(2) In regulation 6, at the end shall be inserted the following paragraph -
"
(3) Where, in the case of -
(a) a tractor component which consists of a tractor engine for the purposes of the Agricultural or Forestry Tractors (Emission of Gaseous and Particulate Pollutants) Regulations 2002[4]; or
(b) a tractor in which such an engine is installed,
that engine is designated by the Secretary of State under regulation 5 of those Regulations as an exempted engine for the purposes of those Regulations, the manufacturer shall make a special note of that designation on the certificate of conformity for that tractor component or tractor."

EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations amend the Agricultural or Forestry Tractors and Tractor Components (Type Approval) Regulations 1988 in consequence of the implementation by the Agricultural or Forestry Tractors (Emissions of Gaseous and Particulate Pollutants) Regulations 2002 (S.I. 2002/1891) of Articles 4.3 to 4.5 of Directive 2000/25 of the European Parliament and of the Council (on action to be taken against the emission of gaseous and particulate pollutants by engines intended to power agricultural or forestry tractors)[

Article 4.5 of Directive 2000/25 permits member states to exempt, subject to certain limitations, individual "end of series" engines from the prohibition required by the Directive on the initial entry into service of engines which do not comply with the emissions requirements it specifies. However, it requires that the manufacturer make a note of an exemption on the relevant certificate of conformity for the relevant engine or tractor.
Regulation 2 of these Regulations introduces this requirement into the 1988 Regulations.
