The Secretary of State, in exercise of the powers conferred on him by sections 411(1), (2)(c), (3)(g) and (7) and 420 (1)(b) of the Greater London Authority Act 1999[
1], and after consultation in accordance with section 411(8) of that Act, hereby makes the following Order:
Citation and commencement
1.
- (1) This Order may be cited as the Warrant Enforcement Staff Pensions Order 2002.
(2) This Order shall come into force on 15th May 2002 but article 2 shall have effect from 1st April 2001.
Continuation of pension scheme membership of warrant enforcement staff
2.
- (1) For the purposes of section 15 of the Superannuation (Miscellaneous Provisions) Act 1967[
2] (pensions of metropolitan civil staffs), the persons described in paragraph (2) are to be regarded as continuing to be members of the metropolitan civil staffs.
(2) The persons referred to in paragraph (1) are persons -
(a) who on 31st March 2001 were employed by the Metropolitan Police Authority in the warrant enforcement function; and
(b) who were transferred to the Greater London Magistrates' Courts Authority on 1st April 2001.
(3) Where payments are made by the Metropolitan Police Authority pursuant to section 15 of the Superannuation (Miscellaneous Provisions) Act 1967 in relation to persons described in paragraph (2), the Greater London Magistrates' Courts Authority shall reimburse the Metropolitan Police Authority for such payments and for the reasonable administrative costs of making such payments.

EXPLANATORY NOTE
(This note is not part of the Order)
This Order provides for warrant enforcement staff to continue to be eligible to be members of the Metropolitan Civil Staffs Superannuation Scheme despite their ceasing to be members of the metropolitan civil staffs as a result of the transfer of their employment to the Greater London Magistrates' Courts Authority. The Order has retrospective effect as permitted by section 411(7) of the Greater London Authority Act 1999.
