Whereas the Charity Commissioners for England and Wales have, in pursuance of section 17(1) of the Charities Act 1993[
1], settled the Scheme set out in the Appendix to this Order with a view to its being given effect under that section:
And whereas the Scheme does not alter any statutory provision contained in or having effect under any public general Act of Parliament:
And whereas a draft of this Order has been laid before Parliament, the period of forty days mentioned in section 6(1) of the Statutory Instruments Act 1946[
2] has expired and neither House of Parliament has within that period resolved that the Order not be made:
Now, therefore, in pursuance of section 17(2) of the Charities Act 1993, the Secretary of State hereby makes the following Order:
1.
This Order may be cited as the Charities (The Bridge House Estates) Order 2001 and shall come into force on the fourteenth day after the day on which it is made.
2.
The Scheme set out in the Appendix to this Order shall have effect.

APPENDIX
SCHEME FOR THE ADMINISTRATION OF THE CHARITY KNOWN AS THE BRIDGE HOUSE ESTATES
Whereas the Charity known as the Bridge House Estates ("the Charity") is now regulated by:
(1) a Royal Charter of the year 1282;
(2) the Blackfriars Bridge Act 1863[
3];
(3) the Blackfriars and Southwark Bridges Act 1867[
4];
(4) the Corporation of London (Tower Bridge) Act 1885[
5];
(5) the Corporation of London (Bridges) Act 1911[
6];
(6) a supplemental Royal Charter dated 26th November 1957;
(7) the London Bridge Act 1967[

(8) the Charities (The Bridge House Estates) Order 1995[

And whereas it is sought to amend the objects and powers of the Charity to enable the Charity to own and maintain the pedestrian bridge across the River Thames between Saint Paul's Cathedral in the City of London and Bankside in the London Borough of Southwark known as the Millennium Bridge;
And whereas the Trustee of the Charity has made application to the Charity Commissioners for a Scheme for the administration of the Charity ("the Scheme");
And whereas it appears to the Charity Commissioners that a Scheme should be established for the purpose of enabling the Charity to own and maintain the Millennium Bridge but that it is necessary for the Scheme to make provision which goes beyond the powers exercisable by them apart from section 17 of the Charities Act 1993 ("the 1993 Act");
And whereas in pursuance of section 20 of the 1993 Act public notice of the Charity Commissioners' proposals for the Scheme has been given and no representations have been received by them in respect thereof;
Now, therefore, the Charity Commissioners in pursuance of section 17(1) of the 1993 Act, hereby settle the following Scheme:
SCHEME
Administration of the Charity
1.
The Charity known as the Bridge House Estates and the property thereof shall be administered and managed upon the subsisting trusts thereof as varied or affected by the provisions of this Scheme.
Purposes of the Charity in relation to the Millennium Bridge
2.
In addition to the ownership and maintenance of Blackfriars Bridge, Southwark Bridge, Tower Bridge and London Bridge, as provided for in the subsisting trusts, the purposes of the Charity shall include the ownership and maintenance of the pedestrian bridge across the River Thames between Saint Paul's Cathedral in the City of London and Bankside in the London Borough of Southwark known as the Millennium Bridge.
Questions relating to the Scheme
3.
Any question as to the construction of this Scheme or as to the regularity or the validity of any acts done or about to be done under this Scheme may be determined by the Charity Commissioners upon such application made to them for the purpose as they think sufficient.

EXPLANATORY NOTE
(This note is not part of the Order)
The Order gives effect to a Scheme of the Charity Commissioners relating to the Charity known as the Bridge House Estates. The Charity was established for the maintenance of London Bridge, and was subsequently empowered to maintain and support London Bridge, Blackfriars Bridge, Southwark Bridge and Tower Bridge.
A new pedestrian bridge known as the Millennium Bridge has been constructed between Saint Paul's Cathedral in the City of London and Bankside in the London Borough of Southwark. It is desired to transfer ownership and maintenance of the Millennium Bridge to the Charity. This Scheme extends the purposes of the Charity to enable it to so own and maintain the Millennium Bridge.
