The Secretary of State for the Environment, Transport and the Regions, in exercise of the powers conferred on him by section 78L(4) of the Environmental Protection Act 1990[
1], hereby makes the following Regulations:
Citation, commencement and extent
1.
- (1) These Regulations may be cited as the Contaminated Land (England) (Amendment) Regulations 2001 and shall come into force on 1st April 2001.
(2) These Regulations extend to England only.
Appeals to a magistrates' court
2.
In regulation 8(6) of the Contaminated Land (England) Regulations 2000[
2] for the words "justices' clerk" there shall be substituted the words "justices' chief executive".

EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations, which extend to England only, amend the Contaminated Land (England) Regulations 2000 to transfer the administrative functions of justices' clerks under them to justices' chief executives.
Similar transfers are made by section 90 of and Schedule 13 to the Access to Justice Act 1999 (c. 22).
