(This note is not part of the Order)
This Order modifies the effect of the Education (Inner London Education Authority) (Property Transfer) Order 1990 ("the 1990 Order").
The transfer of certain land to the councils of inner London boroughs under that Order was made subject to conditions.
The Education (Inner London Education Authority) (Property Transfer) (Modification and Amendment) Order 1997 (S.I. 1997/860) provided that Conditions A, B and C specified in article 2(2) of the 1990 Order should cease to have effect save that Condition C and Condition A, in so far as it was required for the continued operation of Condition C, continued to apply to certain playing fields and sports centres.
Condition A (as amended) provided that, if the land ceased to be used wholly or mainly for the purposes of the council's functions as a local education authority before 1st April 2010, it was to be disposed of and the proceeds divided between all inner London councils.
Condition C provided that, if the land ceased to be used wholly or mainly for the purposes of the council's functions as local education authority or if the council wished to dispose of it, it had first to be offered for transfer to the other inner London councils. If no council wanted the land it was to be disposed of and the proceeds divided as if it were a disposal to which Condition A applied.
This Order further modifies the 1990 Order so that Conditions A and C now cease to apply in their entirety.
Various other Orders which have become spent are revoked.
Conditions A, B and C specified in article 2(2) of the 1990 Order ceased to have effect by virtue of the Education (Inner London Education Authority) (Property Transfer) (Modification and Amendment) Order 1997 (S.I. 1997/860) save that Condition C and Condition A, so far as necessary for the operation of Condition C, continued to have effect in relation to the playing fields etc. listed in Schedule 1 to that Order (and Schedule 1 to this Order).
