(This note is not part of the Order)
This Order appoints a day for the purposes of paragraph 7(1) of Part III of Schedule 2 to the Broadcasting Act 1990. Under paragraph 7(1), before such appointed day, no person holding a licence to provide digital programme services could at any time provide digital programme services by means of two or more television multiplex services, if the number of points attributable to those digital programme services exceeded the permitted maximum. The effect of appointing a day for the purposes of paragraph 7(1) is that from that day, the prohibition in paragraph 7(1) will no longer apply.
1990 c. 42. Part III of Schedule 2 was substituted by paragraph 10 of Part III of Schedule 2 to the Broadcasting Act 1996 (c. 55). Paragraph 7 was amended by the Television Broadcasting Regulations 1998 (S.I. 1998/3196) and the Limit in Relation to Provision of Digital Programme Services Order 1998 (S.I. 1998/2770).
