In exercise of the powers conferred on the Secretary of State by section 8(4) of the Further and Higher Education Act 1992(1), the Secretary of State for Education and Employment hereby makes the following Order:
1. This Order may be cited as the Further Education Funding Council for England (Supplementary Functions) (Amendment) Order 2000 and shall come into force on 1st September 2000.
2. The Further Education Funding Council for England (Supplementary Functions) Order 1999(2) shall be amended as follows.
3. In article 1 for paragraph (2) there shall be substituted the following paragraph-
"(2) In this Order "the Dance and Drama Regulations" means the Education (Grants) Dance and Drama (England) Regulations 1999(3) and the Education (Grants) Dance and Drama (England) Regulations 2000(4)."
4. In article 2-
(a)after paragraph (a) there shall be inserted the following paragraph-
"(aa)the function of specifying requirements which (pursuant to the Dance and Drama Regulations) must be complied with by institutions which provide further education to which grants are paid under those regulations," and
(b)for paragraph (b) there shall be substituted the following paragraph-
"(b)the function of advising the Secretary of State whether such requirements have been complied with,"

This Order amends the Further Education Funding Council for England (Supplementary Functions) Order 1999 in two respects. Firstly it confers on the Further Education Funding Council for England functions exerciseable in connection with the Education (Grants) (Dance and Drama) (England) Regulations 2000 as well as the Education (Grants) (Dance and Drama) (England) Regulations 1999. Secondly it confers on that council the functions of specifying requirements which, under the Dance and Drama Regulations must be complied with.
