The Secretary of State for Social Security, in exercise of the powers conferred by sections 30E, 122(1), 171D, 171G(2) and 175(2) to (4) of, and paragraph 2(3) of Schedule 7 to, the Social Security Contributions and Benefits Act 1992(1) and of all other powers enabling him in that behalf, after agreement by the Social Security Advisory Committee that proposals to make these Regulations should not be referred to it(2), hereby makes the following Regulations:
1. These Regulations may be cited as the Social Security (Therapeutic Earnings Limits) Amendments Regulations 2000 and shall come into force on 2nd October 2000.
2. In regulation 16 of the Social Security (General Benefit) Regulations 1982(3) (earnings level that does not disqualify for unemployability supplement), for the amount "£3,042.00" there shall be substituted "£3,094.00".
3. In regulation 8 of the Social Security (Incapacity Benefit) Regulations 1994(4) (limit of earnings from councillor's allowance), for the amount "£58.50" there shall be substituted "£59.50".
4. In paragraph (2)(a) of regulation 17 of the Social Security (Incapacity for Work) (General) Regulations 1995(5) (exempt work), for the amount "£58.50" there shall be substituted "£59.50".

These Regulations further amend the Social Security (General Benefit) Regulations 1982 (S.I. 1982/1408), the Social Security (Incapacity Benefit) Regulations 1994 (S.I. 1994/2946) and the Social Security (Incapacity for Work) (General) Regulations 1995 (S.I. 1995/311) to take into account the increase in the national minimum wage.
Regulation 2 increases the unemployability supplement earnings level from £3,042.00 to £3,094.00.
Regulation 3 increases the councillor's allowance limit from £58.50 to £59.50.
Regulation 4 increases the incapacity for work therapeutic earnings from £58.50 to £59.50.
These Regulations do not impose a charge on business.
1992 c. 4. Section 30E was inserted by the Social Security (Incapacity for Work) Act 1994 (c. 18), section 3(1). Sections 171D and 171G were inserted by section 6(1) of that Act. Section 175 was amended by paragraph 36 of Schedule 1 to the Social Security (Incapacity for Work) Act 1994 (c. 18) and paragraph 29 of Schedule 3 to the Social Security Contributions (Transfer of Functions, etc.) Act 1999 (c. 2). Sections 122(1) and 171G(2) are cited because of the meaning assigned to the word "prescribe" or "prescribed".
