Compliance with any of the designated codes may be taken into account when considering for the purposes of section 32(1)(b) of the Act whether the belief of a data controller that the publication of any journalistic, literary or artistic material would be in the public interest was reasonable.
This Order revokes and replaces the Data Protection (Designated Codes of Practice) Order 2000. That Order sought to refer to each code by reference to the date of issue. In relation to one code the issue referred to had been superseded by a subsequent issue by the date on which the Order was made. This Order does not refer to dates of issue.
