The Lord Chancellor, in exercise of the powers conferred on him by section 6(4) of the Access to Justice Act 1999(1), having had regard to the matters specified in section 25(3) and having consulted the General Council of the Bar and the Law Society, makes the following Order:
1. This Order may be cited as the Community Legal Service (Funding) (Amendment) Order 2000 and shall come into force on 1st July 2000.
2. In this Order, any reference to an article by number alone is a reference to the article so numbered in the Community Legal Service (Funding) Order 2000(2).
3. This Order shall apply to work carried out on or after 1st July 2000 and work carried out before that date shall be treated as if this Order had not been made.
4. The following words shall be inserted at the beginning of article 5(3):
"Subject to paragraphs (3A) and (3B),".
5. The following paragraphs shall be inserted after article 5(3):
"(3A) In relation to Legal Help and Help at Court within any category of work mentioned in paragraph (3B) which is authorised as a specific category in the schedule to the contract with the Commission under which it is provided, payment shall be at rates no higher than:
(i)8% above those provided in Schedule 6, paragraphs 1 and 2 of the Legal Advice and Assistance Regulations 1989 in respect of fee-earners whose office is situated within the London Region of the Commission; and
(ii)5% above those so provided in respect of all other fee-earners.
(3B) the categories of work mentioned in paragraph (3A) are: immigration/nationality, mental health, education, public law, community care and actions against the police.".

This Order amends the Community Legal Service (Funding) Order 2000 so as to provide for an increase in the rates payable under contracts for the provision of Legal Help and Help at Court in certain categories of case.
