In exercise of the powers conferred on the Secretary of State by sections 1(3)(b) and 8(4) of the Nursery Education and Grant-Maintained Schools Act 1996(1), the Secretary of State for Education and Employment hereby makes the following Regulations:
1.-(1) These Regulations may be cited as the Nursery Education (England) (Amendment) Regulations 1999 and shall come into force on 5th April 1999.
(2) In these Regulations "the principal Regulations" means the Nursery Education (England) Regulations 1998(2).
2. After regulation 1 of the principal Regulations there shall be inserted the following regulation-
"1A. In these Regulations-
"accredited child minder" means a person who at the relevant time is-
registered by a local authority under section 71(1)(a) of the Children Act 1989(3), and
acting as a child minder for the purpose of Part X of that Act within the local authority's area, and
accredited by a recognised organisation or by a body or group of people approved by a recognised organisation for purposes including the bestowing of such accreditation;
"recognised" means recognised by the Secretary of State for purposes including the accreditation of registered childminders;
"the relevant time" means any period of time during which nursery education in respect of which grant is claimed is provided by the person.".
2. After regulation 4(1)(f) of the principal Regulations (recipients of grant) there shall be added-
"(g)accredited child minders.".

These Regulations amend the Nursery Education (England) Regulations 1998 (S.I. 1998/655) by adding to the list of recipients of grant accredited child minders.
Accredited childminders are defined by these Regulations as persons who, when providing nursery education in respect of which grant is claimed, are registered child minders, acting as such for the purposes of Part X of the Children Act 1989, and accredited by, or by persons approved by, a recognised organisation. The Secretary of State will recognise one or more organisations for this purpose.
