Her Majesty, in pursuance of section 1 of the Ministers of the Crown Act 1975(1), is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:
1.-(1) This Order may be cited as the Transfer of Functions (Scientific Research) Order 1999.
(2) This Order shall come into force on 15th November 1999.
2.-(1) The functions of the Secretary of State under section 5(1) of the Science and Technology Act 1965(2) shall be exercisable concurrently by the Minister of Agriculture, Fisheries and Food.
(2) In section 5(1) of that Act-
(a)after the words "Secretary of State", where they appear for the first time, there shall be inserted the words "or the Minister of Agriculture, Fisheries and Food", and
(b)after the words "Secretary of State", where they appear for the second time, there shall be inserted the words "or, as the case may be, the Minister of Agriculture, Fisheries and Food".
(3) Nothing in this article shall be taken as implying that the functions of the Secretary of State under section 99 of the Electricity Act 1989(3) are to become exercisable concurrently by the Minister of Agriculture, Fisheries and Food.

This Order provides for the functions of the Secretary of State under section 5(1) of the Science and Technology Act 1965 to be exercisable concurrently by the Minister of Agriculture, Fisheries and Food. Section 5(1) enables the Secretary of State to pay expenses incurred by him in connection with scientific research which is defined for the purposes of the Act as research and development in any of the sciences (including the social sciences) or in technology.

Relevant amendments to section 5(1) were made by the Transfer of Functions (Science) Order 1992 (S.I. 1992/1296), article 6 and paragraph 2 of the Schedule, the Transfer of Functions (Science) Order 1995 (S.I. 1995/2985), article 5 and paragraph 1 of the Schedule, the Scotland Act 1998 (c. 46), sections 53, 55, 56(1)(d), 117 and 119(2), the Government of Wales Act 1998 (c. 38), sections 43(1) and 89 and the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672), article 2 and Schedule 1.
