The Secretary of State for Wales, in exercise of powers conferred on him by sections 13, 16(1), 17, 18, 126(3) and (4) of the National Health Service Act 1977(1) and of all other powers enabling him in that behalf hereby makes the following Regulations:-“
1.-(1) These Regulations may be cited as the National Health Service (Functions of Health Authorities and Administration Arrangements) Amendment (Wales) Regulations 1999 and shall come into force on 31st July 1999.
(2) In these Regulations, "the principal Regulations" means the National Health Service (Functions of Health Authorities and Administration Arrangements) Regulations 1996(2).
2.-(1) The principal Regulations are amended in accordance with the following paragraphs of this regulation.
(2) In regulation 2(1) (interpretation), after the definition of the "1997 Act"(3) there is inserted the following definition-“
""local health group" means a committee appointed under regulation 14(1) of the Health Authorities (Membership and Procedure) Regulations 1996(4) in accordance with a circular issued by the Secretary of State for Wales in October 1998 entitled "Establishing Local Health Groups(5).""
(3) (a) In the heading to regulation 3A (exercise of functions in adjoining areas: primary care groups)(6), after "primary care groups" add "and local health groups".
(b)In regulation 3A,
(i)in paragraph (1)(b) after "area" delete the full stop and insert "or, as the case may be, that relevant Health Authority has, in accordance with directions given by the Secretary of State for Wales, appointed a local health group to exercise functions in relation to persons on the list of that medical practitioner residing in its own area."
(ii)in paragraph (2), after "the primary care group" insert "or, as the case may be, the local health group".

These Regulations amend the National Health Service (Functions of Health Authorities and Administration Arrangements) Regulations 1996 in relation to Wales by providing for local health groups appointed by Health Authorities to exercise certain additional functions on behalf of neighbouring Health Authorities in certain cases.
1977 c. 49. Section 13 was amended by the Health Services Act 1980 (c. 53) ("the 1980 Act"), paragraph 33 of Schedule 1, by the National Health Service and Community Care Act 1990 (c. 19) ("the 1990 Act"), Schedule 10, and by the Health Authorities Act 1995 (c. 17) ("the 1995 Act"), paragraph 4 of Schedule 1. Sections 16 and 17 were substituted by the 1995 Act, paragraphs 7 and 8 respectively of Schedule 1. Section 18 was amended by the 1980 Act, paragraphs 38 and 92 of Schedule 1, by S.I. 1985/39, article 7, by the 1990 Act, Schedule 10 and by the 1995 Act, section 3(8) and paragraph 9 of Schedule 1. Section 126 was amended by the 1990 Act, section 65(2), by the 1995 Act, paragraph 57 of Schedule 1 and by the National Health Service (Primary Care) Act 1997 (c. 46), Schedule 1, paragraph 27.
The definition of the "1997 Act" was inserted by S.I. 1998/646, regulation 16(2).
