The Secretary of State, in exercise of the powers conferred on him by section 12A(1) and (4) of and paragraph 1 and 3(1)(b) of Schedule 7A to the National Health Service (Scotland) Act 1978(1) and of all other powers enabling him in that behalf, hereby makes the following Order:
1.-(1) This Order may be cited as the Tayside Primary Care National Health Service Trust (Establishment) Amendment Order 1999 and shall come into force on 5th July 1999.
(2) In this Order "the principal Order" means the Tayside Primary Care National Health Service Trust (Establishment) Order 1998(2).
2. For article 3 of the principal Order there is substituted the following:-“
"3.-(1) The trust is established for the purpose specified in Section 12A(1)(b) of the Act.
(2) The trust's functions (which include functions which the Secretary of State considers appropriate in relation to the provision of services by the trust for one or more Health Boards) shall be to provide and manage hospital accommodation facilities at Ashludie Hospital, Monifieth, and at any establishment associated with that hospital, and to provide and manage health care facilities comprising a new acute psychiatric unit and associated facilities adjacent to Ninewells Hospital, Dundee and the support services related thereto, and also including the management of any teaching and research facilities associated with these establishments.".

This Order substitutes a new article 3 in the Tayside Primary Care National Health Service Trust (Establishment) Order 1998 (S.I. 1998/2710).
1978 c. 29; section 12A(1) was inserted by the National Heath Service and Community Care Act 1990 (c. 19) ("the 1990 Act"), section 31; Schedule 7A was inserted by the 1990 Act, Schedule 6; paragraph 1 of Schedule 7A is cited for the definition of "an order".
