These Regulations, made under sections 408, 537 and 537A of the Education Act 1996, apply in relation to schools in England. They consolidate with amendments the Education (School Performance Information) (England) Regulations 1998 ("the 1998 Regulations") as amended, which are revoked.
The Regulations relate to the collection and publication of information about the performance of schools.
Part I of the Regulations comprises general provisions. There is a new definition of "maintained schools", which reflects the changes to the categories of schools which are to take effect on 1st September 1999, pursuant to section 20 of the School Standards and Framework Act 1998 (regulation 2(1)).
Part II imposes duties on head teachers of maintained schools to make available information to governing bodies for the purpose of enabling them to comply with their obligations under these Regulations (regulation 5).
Part III contains detailed provisions relating to the provision of information to the Secretary of State and to local education authorities.
Requirements are imposed on governing bodies of maintained schools under section 537A of the Education Act 1996 (provision of "individual pupil information") as substituted by paragraph 153 of Schedule 30 to the School Standards and Framework Act 1998 with effect from 20th November 1998. The "individual pupil information" to be provided by governing bodies of grant-maintained and grant-maintained special schools to the Secretary of State and, in the case of governing bodies of maintained schools other than those, to the local education authority, relates to pupils at or near the end of the final year of the first key stage (mostly seven year olds) (regulation 6(1) and (2) and Schedule 1). This replaces the requirements for first key stage assessment results information under regulation 6 of the 1998 Regulations.
Governing bodies of maintained primary or middle deemed secondary schools, except special schools, must provide the Secretary of State with information about second key stage assessment results (regulation 7 and Schedule 2).
Governing bodies of maintained schools and proprietors of non-maintained special schools and independent schools with pupils aged 15, 16, 17 or 18 must provide the Secretary of State with specified information about their results (regulation 8 and Schedule 3).
Governing bodies of maintained schools and the proprietors of independent and non-maintained special schools (not providing education for boarders only) must provide the Secretary of State with information about authorised and unauthorised absence (regulation 9 and Schedule 4). Local education authorities are no longer required to provide this information for schools they maintain.
Governing bodies of maintained secondary schools and the proprietors of secondary independent and non-maintained special schools must provide the Secretary of State with general information about the school (regulation 10 and Schedule 5).
Governing bodies of maintained primary schools (including middle-deemed secondary schools but excluding special schools) must also provide the Secretary of State with general information about the school (regulation 11 and Schedule 6).
Part IV is new and requires governing bodies of maintained schools to provide, respectively, the National Data Collection Agency (a body which collates information about pupils' National Curriculum assessment results) and the external marking agency (a body which marks pupils' responses to National Curriculum tests) with individual pupil information relating to pupils who are at or near the end of the final year of, as the case may be, the second or third key stage (regulations 12 and 13 and Schedule 7).
Part V contains provisions relating to the publication of information. Local education authorities are required to publish certain information about the performance of pupils in National Curriculum assessments in the final year of the second key stage at maintained primary or middle-deemed secondary schools, excluding special schools, in their area and other general information relating to those schools. They are also required to provide certain supplementary information about schools, including information about average percentage figures for the performance of pupils in National Curriculum assessments in the final year of the second key stage at all maintained schools providing primary education in the area of the local education authority and at all such schools in England. Copies of the document containing the information to be published by the local education authority are to be provided to the Secretary of State, and governing bodies of all maintained schools and providers of nursery education in the authority's area. They are also to be made available in public libraries in the area of the local education authority (regulation 14 and Schedule 8).
1996 c. 56. Section 408 applies in relation to grant-maintained special schools not established in a hospital and their governing bodies by virtue of S.I. 1994/653, which continues to have effect by virtue of paragraph 1 of Schedule 39 to the Education Act 1996. By the same S.I., section 537(7) is applied in relation to grant-maintained special schools and their governing bodies. Section 537A was substituted by paragraph 153 of Schedule 30 to the School Standards and Framework Act 1998 (c. 31) as from 20th November 1998 by virtue of S.I. 1998/2791 and is modified so as to apply to grant-maintained schools by virtue of S.I. 1998/2916. For the meaning of "prescribed" and "regulations" see section 579(1) of the Education Act 1996.

The Qualifications and Curriculum Authority was established under section 21 of the Education Act 1997 (c. 44).
The categories of maintained schools referred to in relation to the period on and after 1st September 1999 are the new categories of maintained schools which are to apply on and after that date by virtue of section 20 of the School Standards and Framework Act 1998; the new categories will replace the existing categories referred to in relation to the period before that date.
For the tests administered in the school year ending before 12th August 1999, the relevant orders are the Education (National Curriculum) (Assessment Arrangements for the Core Subjects) (Key Stage 2) (England) Order (S.I. 1995/2072, amended by S.I. 1996/2176) and the Education (National Curriculum) (Key Stage 3 Assessment Arrangements) (England) Order 1996 (S.I. 1996/2116, amended by S.I. 1997/2176).
