Whereas, pursuant to section 18(1) of the Agriculture Act 1986(1), the Secretary of State has by Order designated areas in Wales as environmentally sensitive areas;
Now, therefore, the Secretary of State, in exercise of the powers conferred on him by section 18(1) and (4)(2) of the said Act and of all other powers enabling him in that behalf, with the consent of the Treasury hereby makes the following Order:-“
1.-(1) This Order may be cited as the Environmentally Sensitive Areas (Wales) Designation Orders (Amendment) Order 1999 and shall come into force on 11th May 1999.
(2) In this Order "the principal Orders" means the Orders specified in the Schedule to this Order.
2.-(1) The principal Orders shall be amended in accordance with paragraph (2) below.
(2) After article 6 of each of the principal Orders there shall be inserted the following article-“
7. The Secretary of State shall not enter into an agreement with any person unless an application to enter the agreement is received by the Secretary of State before 11th May 1999.".

This Order amends the environmentally sensitive areas designation orders made under section 18 of the Agriculture Act 1986 ("the 1986 Act") designating areas in Wales as environmentally sensitive areas, which implement in part a zonal programme approved by the European Commission under article 7 of Council Regulation (EEC) No. 2078/92 (OJ No. L215, 30.7.92, p. 85) on agricultural production methods compatible with the requirements of the protection of the environment and the maintenance of the countryside.
Section 18(3) of the 1986 Act enables the Secretary of State to enter into a management agreement with any person having an interest in agricultural land in a designated area if the Secretary of State considers that conservation of environmental features in that area may thereby be facilitated. This Order provides that in relation to each of the designated areas the Secretary of State shall not enter into such a management agreement unless the application to enter that agreement has been received by him before 11th May 1999.
