The Secretary of State for the Environment, Transport and the Regions as respects England, the Secretary of State for Wales as respects Wales and the Secretary of State for Scotland as respects Scotland, in exercise of powers conferred by section 2 of the Control of Pollution (Amendment) Act 1989(1), hereby make the following Regulations:
1. These Regulations may be cited as the Controlled Waste (Registration of Carriers and Seizure of Vehicles) (Amendment) Regulations 1998 and shall come into force on 1st April 1998.
2.-(1) The Controlled Waste (Registration of Carriers and Seizure of Vehicles) Regulations 1991(2) shall be amended as follows.
(2) In regulation 4 (applications for registration)-
(a)for paragraphs (6) and (7) there shall be substituted-
"(6) An application for registration or for the renewal of a registration shall be made on a form provided for the purpose by the regulation authority, and shall be accompanied by such information as may reasonably be required by the regulation authority.";
(b)For paragraph (9) there shall be substituted-
"(9) The applicant shall pay the charge prescribed for the purpose by a charging scheme under section 41 of the Environment Act 1995(3) when he makes his application.".
(3) Schedule 2 (application forms) is revoked.

These Regulations amend the procedure for applying for registration under the Controlled Waste (Registration of Carriers and Seizure of Vehicles) Regulations 1991. They-
(a)require applications to be made on a form provided for the purpose by the waste regulation authority (which is the Environment Agency, or in Scotland the Scottish Environment Protection Agency); and
(b)provide for the fees to be charged to an applicant to be those specified in or determined under a scheme made by the appropriate Agency under section 41 of the Environment Act 1995.
1989 c. 14; section 2 was amended by paragraph 37(2) of Schedule 22 to the Environment Act 1995 (c. 25). See the definition of "prescribed" in section 9(1).
