The Secretary of State, in exercise of the powers conferred on him by sections 49(4) and (5) and 143 of the Railways Act 1993(1) and of all other powers enabling him in that behalf, hereby makes the following Order:-“
1. This Order may be cited as The Railways (Ashford) (Exemptions) Order 1998 and shall come into force on 1st November 1998.
2. The light maintenance depot at Ashford, Kent TN23 1EZ ("the specified depot") is a light maintenance depot in relation to which section 41 of the Railways Act 1993 (closure of railways facilities used in connection with passenger services) is not to have effect.
3. The network consisting of-“
(a)the railway lines situated within the specified depot and those running to the specified depot from the junction situated between Ashford International Station and Wye station on the Ashford to Canterbury branch railway line, and
(b)any installations associated with any of the track comprised in those railway lines
is a network in relation to which section 39 of the Railways Act 1993 (closure of operational passenger networks) is not to have effect.

This Order provides that sections 39 and 41 of the Railways Act 1993 (closure of operational passenger networks and facilities used in connection with passenger services) are not to apply to the light maintenance depot at Ashford, Kent and the network consisting of the railway lines and associated installations situated within and running to that depot from the junction situated between Ashford International Station and Wye station on the Ashford to Canterbury branch railway line.
