Whereas the Secretary of State for Education and Employment has received a proposal from the Further Education Funding Council for England, made in accordance with section 51 of the Further and Higher Education Act 1992(1) ("the Act"), for the dissolution under section 27 of the Act of the further education corporations known as North Bolton Sixth Form College and South College, Bolton(2) ("the Old Corporations");
Now therefore in exercise of the power conferred on him by section 27 of the Act the Secretary of State after consulting the Old Corporations and with the consent of the further education corporation known as Bolton Sixth Form College(3) ("the New Corporation") hereby makes the following Order:
1. This Order may be cited as the North Bolton Sixth Form College and South College, Bolton (Dissolution) Order 1998 and shall come into force on 1st August 1998.
2. On 1st August 1998 the Old Corporations shall be dissolved and all of their respective property, rights and liabilities shall be transferred to the New Corporation, being a body corporate established for purposes which include the provision of educational facilities or services.
3. Section 26(2), (3) and (4) of the Act shall apply to any person employed by either of the Old Corporations immediately before 1st August 1998 as if the references in that section-
(a)to a person to whom that section applies were to a person so employed;
(b)to the operative date were to 1st August 1998;
(c)to the transferor were to either of the Old Corporations (as the case may be); and
(d)to the corporation were to the New Corporation.

This Order dissolves the further education corporations established to conduct North Bolton Sixth Form College and South College, Bolton. It provides that the property, rights and liabilities of the two colleges transfer to Bolton Sixth Form College and secures the rights of its employees by applying section 26(2) to (4) of the Further and Higher Education Act 1992.
Established by the Education (Further Education Corporations) Order 1992 (S.I. 1992/2097). The name of South Bolton Sixth Form College was changed to South College, Bolton on 1st September 1995, pursuant to clause 19 of Schedule 1 to the Education (Government of Further Education Corporations) (Former Further Education Colleges) Regulations 1992 (S.I. 1992/1963).
