1. These regulations may be cited as the Coast Protection (Variation of Excluded Waters) Regulations 1997 and shall come into force on 12th December 1997.
2. For paragraph 9 of Schedule 4 to the Coast Protection Act 1949 (which, for the purposes of Part I of the Act excludes from the definitions of "sea" and "seashore" the River Esk (Yorkshire) above a line drawn from the seaward end of the West Pier to the seaward end of the East Pier at Whitby) there shall be substituted the following paragraph-
"9. The River Esk (Yorkshire) above a line drawn from the southern edge of Tate Hill Pier to the southern edge of Scotch Head at Whitby.".

Schedule 4 to the Coast Protection Act 1949 specifies waters which, for the purposes of Part I of the Act (coast protection), are not included in the expressions "sea" and "seashore".
These Regulations vary Schedule 4 so as to extend the part of the River Esk (Yorkshire) which is included in those expressions.
