Whereas, this being an Order relating to local authorities in England and Wales only, the Secretary of State has, pursuant to section 70(3) of the Deregulation and Contracting Out Act 1994(1), consulted such representatives of local government as he considers appropriate,
Whereas a draft of this Order has been laid before Parliament and approved by a resolution of each House of Parliament under section 77(2) of that Act,
Now therefore the Secretary of State, in exercise of the powers conferred on him by sections 70 and 77(1) of that Act and of all other powers enabling him in that behalf, hereby makes the following Order:
1.-(1) This Order may be cited as the Contracting Out (Functions in relation to the provision of Guardians Ad Litem and Reporting Officers Panels) Order 1996.
(2) This Order shall come into force on the day after the day on which it is made.
(3) In this Order "the 1991 Regulations" means the Guardians Ad Litem and Reporting Officers (Panels) Regulations 1991(2).
2.-(1) Any function of a local authority which is conferred by the 1991 Regulations may be exercised by, or by employees of, such person (if any) as may be authorised in that behalf by that local authority.
(2) Where any function of a local authority which is conferred by the 1991 Regulations is exercised by a person other than the authority in accordance with paragraph (1) of this article, Schedule 1 to the 1991 Regulations (complaints board) shall have effect in relation to that authority as if in paragraph (a) at the end there were inserted the words "nor a person who is authorised to exercise any function of the local authority which is conferred by these Regulations in accordance with article 2 of the Contracting Out (Functions in relation to the provision of Guardians Ad Litem and Reporting Officers Panels) Order 1996, nor an employee of such person".

This Order makes provision to enable a local authority in England and Wales to authorise another person, or that person's employees, to exercise the authority's functions in relation to the provision of a panel of guardians ad litem and reporting officers for their area. Article 2(2) makes a consequential modification to the Guardians Ad Litem and Reporting Officers (Panels) Regulations 1991.
