1. This Scheme may be cited as the M23 Motorway (Balcombe Road Interchange) Connecting Roads Scheme 1996 and shall come into force on 16th December 1996.
2. In this Scheme:
(1) all measurements of distance are measured along the route of the relevant highway;
(i) | "connecting road" | means a special road along a route described in the Schedule to this Scheme; |
(ii) | "the plan" means the plan numbered SNPR96/7 marked "The M23 Motorway (Balcombe Road Interchange) Connecting Roads Scheme 1996", signed by authority of the Secretary of State for Transport and deposited at the Department of Transport, Great Minster House, Marsham Street, London SW1P 4DR; and | |
(iii) | "the special roads" | means each connecting road. |
3. The Secretary of State is authorised to provide the special roads for the exclusive use of traffic of Classes I and II of the classes of traffic set out in Schedule 4 to the Highways Act 1980.
4. The centre line of each of the special roads is indicated by a heavy black line on the plan.
5. Each of the special roads shall become a trunk road on the date when this Scheme comes into force.

The routes of the connecting roads are as follows:
(a)A route to connect the new roundabout on Balcombe Road, which West Sussex County Council have constructed to the north of the motorway in connection with a new development at Maidenbower, with the northbound carriageway of the M23 Motorway (the special road along this route being given the number 1 on the plan).
(b)A route to connect the southbound carriageway of the M23 Motorway with a new roundabout on Balcombe Road which will be constructed to the south of the motorway under the powers of The M23 Motorway (Balcombe Road Interchange) (Side Roads) Order 1996 (the special road along this route being given the number 2 on the plan).
