The Secretary of State for the Environment, in exercise of the powers conferred on him by section 74 of the Housing Act 1988(1) and of all other powers enabling him in that behalf, after consulting the council of the City of Kingston upon Hull(2) and taking such steps as appear to him to be appropriate in accordance with section 75(3) of that Act, hereby makes the following Order:
1.-(1) This Order may be cited as the North Hull Housing Action Trust (Transfer of Property) Order 1996 and shall come into force on 28th May 1996.
(2) In this Order-
"the council" means the council of the City of Kingston upon Hull;
"the transfer date" means 28th May 1996; and
"the trust" means the North Hull Housing Action Trust.
2. The interest of the council in the housing and other land within the area designated as a housing action trust area by the North Hull Housing Action Trust (Area and Constitution) Order 1991(3) and specified in the Schedule to this Order shall vest in the trust on the transfer date together with all easements and rights vested in the council which are annexed or appurtenant to the land transferred by this Order (or any part of the land).
3. The trust shall be entitled to all money paid to it or to the Council in the period from 27th January 1992 to the transfer date in respect of rent under tenancies of any of the housing transferred by this Order.

This Order vests in the North Hull Housing Action Trust the housing and other land specified in the Schedule to the Order which is currently vested in the council of the City of Kingston upon Hull (article 2) and makes provision for rent paid to it or to the Council since 27th January 1992 under tenancies of any of the housing (article 3). The property transferred is in the area designated by the North Hull Housing Action Trust (Area and Constitution) Order 1991 which established the North Hull Housing Action Trust and was in error omitted from the North Hull Housing Action Trust (Transfer of Property) Order 1992 (S.I. 1992/1) and also from the North Hull Housing Action Trust (Transfer of Property) (No. 2) Order 1992 (S.I. 1992/1754).
