(This note is not part of the Regulations)
These Regulations amend the Motorways Traffic (Scotland) Regulations 1995 ("the 1995 Regulations") which regulate the use of motorways.
Regulation 11 of the 1995 Regulations prohibits certain classes of vehicle from using the right-hand lane of motorways where a carriageway has three or more lanes. Regulation 11(1)(b) is substituted so that passenger vehicles, which are constructed or adapted to carry eight or more seated persons in addition to the driver and that have a maximum laden weight that exceeds 7.5 tonnes, shall be prohibited vehicles for the purpose of that regulation.
The effect of this amendment is that it widens the range of passenger carrying vehicles prohibited from using the right hand lane of a motorway, when there are three or more lanes.
1984 c. 27; section 17(2) was amended by the New Roads and Street Works Act 1991 (c. 22) ("the 1991 Act"), Schedule 8, paragraph 28(3) and by the Road Traffic Act 1991 (c. 40), Schedule 4, paragraph 25 and Schedule 8.
Section 134(2) was amended by the Roads (Scotland) Act 1984 (c. 54), Schedule 7, paragraph 4 and by the 1991 Act, Schedule 8, paragraph 77.
