The Secretary of State, in exercise of the powers conferred on him by sections 15 and 17(2) of the Natural Heritage (Scotland) Act 1991(1) and of all other powers enabling him in that behalf, on the application of the Tay River Purification Board in accordance with Schedule 5 to that Act and no objection to that application having been made, hereby makes the following Order:
1. This Order may be cited as the Tay River Purification Board (Ordie Burn) Control Order 1995 and shall come into force on 11th September 1995.
2. This Order-
(a)applies to all inland waters or ground waters within the control area specified in article 3 below; and
(b)relates to the abstraction of water for the purpose of irrigation-
(i)in any form; and
(ii)for the benefit of any agricultural or horticultural activity which, in itself, is carried out on a commercial basis.
3. The control area is specified as being the area lying within the area of the Tay River Purification Board shown coloured orange on the plan annexed and signed as relative to and part of this Order.
4. The closing date by which an application for a licence under section 17(1) of the Natural Heritage (Scotland) Act 1991 should be made is specified as 31st October.
