Whereas the Secretary of State is a Minister designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to measures relating to consumer protection as regards package travel, package holidays and package tours:
Now, therefore, the Secretary of State in exercise of the powers conferred on him by section 2(2) of that Act hereby makes the following Regulations:-
1. These Regulations may be cited as the Package Travel, Package Holidays and Package Tours (Amendment) Regulations 1995 and shall come into force on the day after the day on which they are made.
2. The Package Travel, Package Holidays and Package Tours Regulations 1992(3) are hereby amended as follows-
(a)in regulation 2(1) after the definition of "the Directive" there shall be inserted the following definition-
""member State" means a member State of the European Community or another State in the European Economic Area;";
(b)in regulation 17(7) in the definition of "authorised institution" after the words "member State" there shall be inserted the following words ", of the Channel Islands or of the Isle of Man"; and
(c)in regulation 18(6)(a) after the words "member State" there shall be inserted the following words ", the Channel Islands or the Isle of Man".

These Regulations amend the Package Travel, Package Holidays and Package Tours Regulations 1992 (S.I. 1992/3288) so as to permit an organiser, retailer and approved body to enter into a bonding arrangement with a person authorised in the Channel Islands or the Isle of Man to carry on the business of entering into bonds. Further they permit an approved body to have insurance cover with an insurer authorised in the Channel Islands or the Isle of Man. In addition these Regulations update the reference to a member State to include reference to any state in the European Economic Area (regulation 2).
