The Secretary of State for Health, in exercise of the powers conferred on her by section 92(1) of the National Health Service Act 1977(1) and of all other powers enabling her in that behalf, having regard to the change in the arrangements for the administration of hospitals and other establishments and facilities formerly managed by the South Durham Health Authority resulting from the establishment of the Bishop Auckland Hospitals National Health Service Trust(2), having consulted that Health Authority and that Trust in accordance with section 92(3) of that Act, hereby makes the following Order:
1.-(1) This Order may be cited as the Bishop Auckland Hospitals National Health Service Trust (Transfer of Trust Property) Order 1995 and shall come into force on8th June 1995.
(2) In this Order-
"the Authority" means the South Durham Health Authority;
"the Trust" means the Bishop Auckland Hospitals National Health Service Trust;
"the trust property" means the items specified in a schedule of trust property prepared by and agreed upon by the Authority and the Trust on13th December 1994, which schedule has been signed on behalf of both the Authority and the Trust.
2. On 8th June 1995 the trust property shall be transferred from the Authority to the Trust.

This Order transfers to the Bishop Auckland Hospitals National Health Service Trust on 8th June 1995 trust property formerly held by the South Durham Health Authority. A copy of the schedule of trust property to which the Order refers can be obtained from the Department of Health, NHS Trust Unit, Room 1W29, Quarry House, Quarry Hill, Leeds LS2 7UE.
