The Secretary of State for Trade and Industry (as respects England, Wales and Northern Ireland) and the Secretary of State for Scotland (as respects Scotland), in exercise of the powers conferred on them by section 16(1A) of the Nuclear Installations Act 1965(1) and of all other powers enabling them in that behalf, and with the approval of the Treasury, hereby make the following Order, a draft of which has been laid before and approved by a resolution of the House of Commons:-
1. This Order may be cited as the Nuclear Installations (Increase of Operators' Limits of Liability) Order 1994 and shall come into force on 1st April 1994.
2. In section 16(1) of the Nuclear Installations Act 1965(2) (limitation of operator's liability in respect of any occurrence), for the words "£20 million" and "£5 million" there shall be substituted the words "£140 million" and "£10 million" respectively.

This Order increases the maximum amount payable as compensation, by a person liable by virtue of a breach of a duty imposed on him by section 7, 8 or 9 of the Nuclear Installations Act 1965, in respect of any one occurrence constituting such a breach. That amount is increased from £20 million to £140 million or, in the case of licencees of sites prescribed under the Nuclear Installations (Prescribed Sites) Regulations 1983 (S.I. 1983/919), from £5 million to £10 million.
