In exercise of the powers conferred on the Secretary of State by section 187 of the Education Act 1993(1), the Secretary of State for Education hereby makes the following Regulations:
1. These Regulations may be cited as the Education (Groups including Grant-maintained Special Schools) Regulations 1994 and shall come into force on 8th April 1994.
2. "The 1993 Act" in these Regulations means the Education Act 1993.
3. For the purposes referred to in section 187(1) of the 1993 Act Chapter IX of Part II of that Act is modified as follows:
(a)references to grant-maintained schools shall be read so as to includegrant-maintained special schools and references to grant-maintained status shall be construed accordingly;
(b)in section 126 the references to section 84(1) and to section 90(1) shall, in relation to a grant-maintained special school, be to those sections as modified by any regulations made under paragraph 14 of Schedule 11 to the 1993 Act(2);
(c)the requirements in section 127(2)(a) and (b) shall not apply in relation to a maintained special school established in a hospital.

These Regulations, made under section 187 of the Education Act 1993, modify Chapter IX of Part II of the Act (which enables schools to join together as groups ofgrant-maintained schools). The effect of the modification is to extend the relevant provisions to grant-maintained special schools.

Sections 84 and 90 of the 1993 Act are amongst the sections applied to grant-maintained special schools by regulation 23 of the Education (Grant-maintained Special Schools) Regulations 1994 (S.I. 1994/653).
