The Secretary of State for Transport, in exercise of the powers conferred on him by sections 89(3)(1) and (4)(b)(2), 105(1), (3) and (4), 108(1)(3) and 192(1)(4) of the Road Traffic Act 1988(5), after consulting with representative organisations in accordance with section 195(2) of that Act, and with the approval of the Treasury, hereby makes the following Regulations:-
1. These Regulations may be cited as the Motor Vehicles (Driving Licences) (Large Goods and Passenger-Carrying Vehicles) (Amendment) Regulations 1994 and shall come into force on 1st April 1994.
2. The Motor Vehicles (Driving Licences) (Large Goods and Passenger-Carrying Vehicles) Regulations 1990(6) shall be amended in accordance with regulations 3 and 4 below.
3. In regulation 15(7) (Applications for tests), for paragraph
(2) there shall be substituted-
"(2) An applicant for such an appointment shall, when making the application, specify the category of vehicle in respect of which he desires to take the test and pay-
(a)in respect of a test to be conducted between Monday and Friday (inclusive of both those days), £62; and
(b)in respect of a test to be conducted on a Saturday, £80.".
4. In regulation 18 (Requirements for tests), for paragraph (1)(b) there shall be substituted-
"(b)sign, on the Driving Test Report Form produced to him by the examiner before the test commences, a declaration that there is in force, in relation to the use of the vehicle provided for the purposes of the test, a policy of insurance which complies with the requirements of Part VI of the Road Traffic Act 1988;".
5. Regulation 3 above shall not apply in the case of an application for an appointment for a test duly made before 1st April 1994, in respect of which the fees prescribed by virtue of the Motor Vehicles (Driving Licences) (Large Goods and Passenger-Carrying Vehicles) (Amendment) Regulations 1993(8) apply.

These Regulations-
amend regulation 15 of the Motor Vehicles (Driving Licences) (Large Goods and Passenger-Carrying Vehicles) Regulations 1990 so as to increase, for test applications made on or after 1st April 1994, the fees for driving tests for entitlement to drive large goods or passenger-carrying vehicles; and
amend regulation 18 of those Regulations so as to require a test candidate to make a signed declaration before taking the test that the vehicle in which the test is to be taken meets the insurance requirements of Part VI of the Road Traffic Act 1988.
The test fees applicable after the coming into force of these Regulations are as follows-

Section 89(3) was amended by the Road Traffic Act 1991 (c. 40), section 48 and Schedule 4, paragraph 63.
Section 89(4)(b) is to be read with the Department of Transport (Fees) Order 1988 (S.I. 1988/643), as amended by S.I. 1991/811 and 1993/1601, the relevant entry being in Schedule 1 Table VI, item 1A.
