The Minister of Agriculture, Fisheries and Food, the Secretary of State for Scotland and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred by sections 74A and 84 of the Agriculture Act 1970(1) and of all other powers enabling them in that behalf, after consultation in accordance with section 84(1) of the said Act with such persons or organisations as appear to them to represent the interests concerned, and the Minister of Agriculture, Fisheries and Food and the Secretary of State, being Ministers designated(2) for the purposes of section 2(2) of the European Communities Act 1972(3) in relation to the common agriculture policy of the European Community, acting jointly, in exercise of the powers conferred on them by the said section 2(2), and of all other powers enabling them in that behalf, hereby make the following Regulations:
1. These Regulations may be cited as the Feeding Stuffs (Amendment) Regulations 1994 and shall come into force on 31st March 1994.
2. The Feeding Stuffs Regulations 1991(4) shall be further amended in accordance with regulation 3 below.
3.-(1) In Schedule 4-
(a)in Part III ("PERMITTED EMULSIFIERS, STABILISERS, THICKENERS AND GELLING AGENTS")
(i)in Chapter A, after the provisions relating to Microcrystalline cellulose there shall be inserted the following provisions:
"E460(ii) | Cellulose powder" |
(ii)in Chapter B, after the provisions relating to Partial polyglycerol esters of polycondensed fatty acids of castor oil (polyglycerol polyricinoleate) there shall be added the following provisions:
"E499 | Cassia Gum | Dogs, Cats | 17600 | Canned feeding stuffs only" |
(b)in Part VII ("AROMATIC AND APPETISING SUBSTANCES"), in Columns 4 and 6 opposite the reference to the additive Neohesperidine dihydrochalcone, there shall be added the following provisions:

(2) In Schedule 7-
(a)after the provisions relating to item 2.2.2 ("Ammonium acetate in aqueous solution") there shall be inserted the following provisions:

(b)after the provisions relating to item 3.1.4 ("Concentrated liquid sodium DL-Methionine technically pure") there shall be inserted the following provisions:

(c)after the provisions relating to item 3.2.6 ("L-Lysine phosphate and its by-products produced by fermentation with Brevibacterium lactofermentum NRRLB-11470") there shall be inserted the following provisions:

These Regulations further amend the Feeding Stuffs Regulations 1991 ("the principal Regulations") and implement the following Community legislation:
1. Commission Directive 93/26/EEC (OJ No. L179, 22.7.93, p.2) amending the Annex to Council Directive 82/471/EEC concerning certain products used in animal nutrition (regulation 3(2)(b), (c) and (d));
2. Commission Directive 93/27/EEC (OJ No. L179, 22.7.93, p.5) amending the Annexes to Council Directive 70/524/EEC concerning additives in feeding stuffs (regulation 3(1)(a)(i) and (b));
3. Commission Directive 93/55/EEC (OJ No. L206, 18.8.93, p.11) amending Annex I to Council Directive 70/524/EEC (regulation 3(1)(a)(ii));
4. Commission Directive 93/56/EEC (OJ No. L206, 18.8.93, p.13) amending the Annex to Council Directive 82/471/EEC (regulation 3(2)(a) . . . and (d)).
Regulation 3(1) amends Schedule 4 to the principal Regulations, which relates to permitted additives in feeding stuffs. Regulation 3(2) amends Schedule 7 to those Regulations, which relates to certain products used in animal nutrition.
1970 c. 40; section 74A was inserted by the European Communities Act 1972, c. 68, Schedule 4, paragraph 6, and the Act was amended by the Agriculture Act 1970 Amendment Regulations 1982 (S.I. 1982/980). Section 66(1) contains definitions of the expressions "the Ministers", "prescribed" and "regulations"; the definition of "the Ministers" was amended by the Transfer of Functions (Wales) (No. 1) Order 1978 (S.I. 1978/272), Schedule 5, paragraph 1.
