In exercise of the powers conferred on me by section 102(2) of the Criminal Justice Act 1991(1), I hereby make the following Order:
1. This Order may be cited as the Criminal Justice Act 1991 (Commencement No. 4) Order 1994.
2. Sections 12 and 13 of the Criminal Justice Act 1991(2) shall come into force on 9th January 1995.

This Order provides for the coming into force, on 9th January 1995, of sections 12 and 13 of the Criminal Justice Act 1991, which provide for the making of curfew orders and the electronic monitoring of such orders. The previous commencement orders are S.I.s 1991/2208, 1991/2706 (applies to Scotland only) and 1992/333. This Order completes the commencement of the 1991 Act subject to the saving made by article 2(4) of S.I. 1992/333 (coming into force of section 68 not to have effect in relation to certain provisions for treating 17 year olds as young persons) and to the coming into force, on a day to be appointed by the Secretary of State under section 62(1) of the 1991 Act, of the provisions set out in Schedule 3 to S.I. 1992/333. Those provisions relate to young persons committed to custody and their accommodation, as well as matters of interpretation, certain minor and consequential amendments, transitional provisions and repeals.
Section 12 is amended by paragraph 41 of Schedule 9 to the Criminal Justice and Public Order Act 1994 (c. 33).
