The Minister of Agriculture, Fisheries and Food and the Secretary of State, being Ministers designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the common agricultural policy of the European Community, acting jointly, in exercise of the powers conferred on them by the said section 2(2) and of all other powers enabling them in that behalf, hereby make the following Regulations:
1. These Regulations may be cited as the Dairy Produce Quotas (Amendment) (No. 2) Regulations 1994 and shall come into force on 8th December 1994.
2. The Dairy Produce Quotas Regulations 1994(3) shall be amended in accordance with the following provisions of these Regulations.
3. In regulation 13 (transfer of quota without transfer of land), in paragraph (2)(c)(i), after the words "the provisions of this regulation" there shall be inserted the words "(other than by a transfer in respect of which, pursuant to paragraph (7), he has been released from the undertaking referred to in subparagraph (d)(i))".
4. In regulation 15 (temporary transfer of quota)-
(a)at the beginning of paragraph (3) there shall be inserted the words "Subject to paragraph 3A,"; and
(b)after paragraph (3) there shall be inserted the following paragraph: "(3A) In the quota year commencing on 1st April 1994, the notice described in paragraph (3) shall be submitted to the Intervention Board no later than 31st December 1994.".

These Regulations amend the Dairy Produce Quotas Regulations 1994 ("the principal Regulations").
Regulation 4 amends regulation 15 of the principal Regulations so that, as regards the quota year commencing on 1st April 1994, the date by which a transferee of quota must notify the Intervention Board of an agreement made for the temporary transfer of quota in accordance with that regulation is extended to 31st December 1994.
Regulation 3 amends the undertaking required to be given by a transferor of quota under regulation 13 of the principal Regulations (which concerns applications for a transfer of quota without transfer of land).
The expressions "quota", "quota year", "transferee" and "transferor" are defined in regulation 2(1) of the principal Regulations.
