1. This Order may be cited as the Education (National Curriculum) (Attainment Targets and Programmes of Study in Science) (Amendment) Order 1994 and shall come into force on 1st August 1994.
2. The Education (National Curriculum) (Attainment Targets and Programmes of Study in Science) Order 1991(3) is hereby amended-
(a)by the substitution in article 7 for the words "articles 8 to 10" of the words "articles 7A to 10";
(b)by the insertion after article 7 of the following article-
"7A.-(1) The programme of study set out in the Document and specified by article 9 and Schedule 2 in relation to the third key stage and which relates to attainment target 2 (life and living processes)(4) is hereby amended-
(a)by the deletion of the words "(including Human Immunodeficiency Virus (HIV))" and "and understand the need to have a responsible attitude to sexual behaviour", and
(b)by the insertion after the word "adolescence" of the word "and".
(2) No programme of study in the Document shall include-
(a)Acquired Immune Deficiency Syndrome and Human Immunodeficiency Virus,
(b)any other sexually transmitted disease, or
(c)aspects of human sexual behaviour, other than biological aspects.".

This Order amends the Education (National Curriculum) (Attainment Targets and Programmes of Study in Science) Order 1991 and the Document to which that Order gives statutory effect specifying the attainment targets and programmes of study for science in the National Curriculum.
The matters set out in paragraph (2) of new article 7A inserted by this Order, which are concerned with sex education, are excluded from the programmes of study in the Document, and amendments are made to the programme of study relating to attainment target 2 (life and living processes) for the third key stage.
1988 c. 40; section 4 was amended by section 240 of the Education Act 1993 (c. 35) in a way not material to this instrument, and its exercise in relation to the subject-matter of the instrument is required by section 241 of that Act.
Sections 20, 21 and 232(4) of the Education Reform Act 1988 are disapplied in the case of this Order by section 241 of the Education Act 1993.
