In exercise of the power conferred on him by section 27 of the Further and Higher Education Act 1992(1), the Secretary of State for Education, with the consent of St Austell College and after consulting St Austell Sixth Form College, Mid-Cornwall College and the Further Education Funding Council for England, hereby makes the following Order:
1. This Order may be cited as the Education (St Austell Sixth Form College and Mid-Cornwall College) (Dissolution) Order 1993 and shall come into force on 2nd April 1993.
2. In this Order references to St Austell Sixth Form College, Mid-Cornwall College and St Austell College are to the further education corporations respectively known by those names.
3. On 2nd April 1993 St Austell Sixth Form College and Mid-Cornwall College shall be dissolved and all of their respective property, rights and liabilities shall be transferred to St Austell College (being a body corporate established(2) for purposes which include the provision of educational facilities or services).
4. Section 26(2), (3) and (4) of the Further and Higher Education Act 1992 shall apply to any person employed immediately before 2nd April 1993 by St Austell Sixth Form College or Mid-Cornwall College as if the references in that section-
(a)to a person to whom that section applies were to a person so employed;
(b)to the operative date were to 2nd April 1993;
(c)to the transferor were to St Austell Sixth Form College or Mid-Cornwall College (as the case may be); and
(d)to the corporation were to St Austell College.

This Order dissolves the further education corporations established to conduct St Austell Sixth Form College and Mid-Cornwall College consequent on their merger on 2nd April 1993 to form St Austell College. It provides that the property, rights and liabilities of the two colleges transfer to St Austell College and secures the rights of employees by applying section 26(2) to (4) of the Further and Higher Education Act 1992.
