In exercise of the powers conferred on the Secretary of State by sections 16A(2) and 63(3) of the Education (No. 2) Act 1986(1) and sections 89(1A) and 232(5) of the Education Reform Act 1988(2) the Secretary of State for Education, as respects England, and the Secretary of State for Wales, as respects Wales, hereby make the following Regulations:
1.-(1) These Regulations may be cited as the Education (Further Education in Schools) Regulations 1993 and shall come into force on 1st September 1993.
(2) In these Regulations-
(a)"the 1986 Act" means the Education (No. 2) Act 1986; and
(b)"the 1988 Act" means the Education Reform Act 1988.
2.-(1) The circumstances referred to in section 16A(2) of the 1986 Act and in section 89(1A) of the 1988 Act shall be that a teacher is present in the room.
(2) For the purposes of paragraph (1) a teacher means a member of the teaching staff of-
(a)a school maintained by a local education authority;
(b)an institution maintained or assisted by a local education authority other than a school;
(c)a grant-maintained school;
(d)a city technology college; or
(e)an institution within the further education sector.
(3) For the purposes of paragraph (1) a teacher shall be considered to be present in the room at a particular time even though no teacher is present if-
(a)it would be impracticable to secure the presence of a teacher in the room at that time, and
(b)the absence of a teacher at that time has not lasted more than five minutes.

These Regulations prescribe the circumstances in which the governing bodies of county, voluntary, maintained special or grant-maintained schools may provide further education in rooms where pupils are being taught. They prescribe that they may do so when a teacher is present.
