Coming into force in accordance with Article 1(2)
The Secretary of State, in exercise of the powers conferred on him by section 1 of the Import of Live Fish (Scotland) Act 1978((1)) and of all other powers enabling him in that behalf after having consulted Scottish Natural Heritage and other persons he considers appropriate and being of the opinion that the species of live fish to which this Order applies might prey on or harm the habitat of freshwater fish or salmon in Scotland, hereby makes the following Order-“
1.-(1) This Order may be cited as the Prohibition of the Keeping or the Release of Live Fish (Pikeperch) (Scotland) Order 1993.
(2) This Order-“
(a)in respect of pikeperch kept after 8th June 1993 shall come into force on that date; and
(b)in respect of pikeperch kept on or before 8th June 1993 shall come into force on 8th September 1993.
(3) This Order applies to the pikeperch species (Stizostedion lucioperca) which species is not native to Scotland.
2. On or after the date of the coming into force of this Order in accordance with article 1(2) the keeping or the release in Scotland of live fish of the pikeperch species or live eggs of such fish is prohibited except under licence.

This Order prohibits the keeping or release in Scotland of live fish of the pikeperch species (Stizostedion lucioperca), (also called zander), or live eggs of such fish except under licence granted by the Secretary of State. The prohibition comes into force (a) on 8th June 1993 in respect of pikeperch kept after that date (b) on 8th September 1993 in respect of pikeperch first kept on or before 8th June 1993. Pikeperch are not native to Scotland and in the opinion of the Secretary of State might prey on or harm the habitat of freshwater fish or salmon in Scotland unless their keeping or release is regulated.
