The Minister of Agriculture, Fisheries and Food, the Secretary of State for Health and the Secretary of State for Wales, acting jointly, in relation to England and Wales, and the Secretary of State for Scotland in relation to Scotland, in exercise of the powers conferred on them by sections 16(1) and 48(1)(c) of the Food Safety Act 1990(1) and of all other powers enabling them in that behalf, hereby make the following Regulations, after consultation in accordance with section 48(4) of the said Act with such organisations as appear to them to be representative of interests likely to be substantially affected by the Regulations:-
1.-(1) These Regulations may be cited as the Soft Drinks (Amendment) Regulations 1993.
(2) Regulations 1, 2 and 4 shall come into force on 1st June 1993 and all other regulations thereof shall come into force on 1st January 1994.
2. The Soft Drinks Regulations 1964(2) shall be amended as specified in Schedule 1 to these Regulations.
3. Regulation 5(2) of the Soft Drinks Regulations 1964 shall be amended by deleting proviso (a).
4. The Soft Drinks (Scotland) Regulations 1964(3) shall be amended as specified in Schedule 2 to these Regulations.
5. Regulation 6(2) of the Soft Drinks (Scotland) Regulations 1964 shall be amended by deleting proviso (a).

Regulation 2
1. Regulation 5(2) shall be amended-
(a)by substituting the word "quantity" for the word "quantities";
(b)by deleting the words "added sugar and";
(c)by deleting proviso (b).
2. Regulation 5(3) shall be amended-
(a)by substituting the word "quantity" for the word "quantities";
(b)by deleting the words "added sugar and".
3. In Regulation 5(5) the words "a minimum quantity of added sugar or" shall be deleted.
4. Regulation 7A shall be amended-
(a)by substituting the word "quantity" for the word "quantities";
(b)by deleting the words "added sugar and".
5. In Schedule 2 there shall be deleted from Parts I and II respectively, column 3 and all the figures and words contained within the said column.
6. In Schedule 3 there shall be omitted from Parts I and II respectively, that part of column 3 headed "Minimum" and all the figures and words contained within that part of that column.
Regulation 4
1. Regulation 6(2) shall be amended-
(a)by substituting the word "quantity" for the word "quantities";
(b)by deleting the words "added sugar and";
(c)by deleting proviso (b).
2. Regulation 6(3) shall be amended-
(a)by substituting the word "quantity" for the word "quantities";
(b)by deleting the words "added sugar and".
3. In Regulation 6(5) the words "a minimum quantity of added sugar or" shall be deleted.
4. Regulation 8A shall be amended-
(a)by substituting the word "quantity" for the word "quantities";
(b)by deleting the words "added sugar and".
5. In Schedule 2 there shall be deleted from Parts I and II respectively, column 3 and all the figures and words contained within the said column.
6. In Schedule 3 there shall be omitted from Parts I and II respectively, that part of column 3 headed "Minimum" and all the figures and words contained within that part of that column.

These Regulations amend the Soft Drinks Regulations 1964 and the Soft Drinks (Scotland) Regulations 1964. They remove the minimum sugar composition requirements (regulation 2 and Schedule 1 paragraphs 1, 2, 5 and 6 and regulation 4 and Schedule 2 paragraphs 1, 2, 5 and 6) and make amendments consequent thereto.
The higher maximum permitted quantities of saccharin specified in Schedule 2 Part II of those Regulations for soft drinks for consumption after dilution other than semi sweet soft drinks continue to apply, until 1st January 1994, to soft drinks other than semi sweet soft drinks intended for consumption without dilution (other than soda water) provided that such soft drinks contain not less than 22½ pounds of sugar per 10 gallons (regulations 1(2), 3 and 5).
