HARBOURS, DOCKS, PIERS AND FERRIES

Whereas the Weymouth and Portland Borough Council have applied for a harbour revision order under section 14 of the Harbours Act 1964(1) (hereinafter called "the Act");
And whereas there were objections made and not withdrawn to the application for the Order, and an inquiry was held in accordance with paragraph 4(5) of Schedule 3 to the Act;
And whereas after consideration of the objections made and not withdrawn and of the report of the person holding the inquiry the Secretary of State for Transport is satisfied that the making of the following Order is desirable:
1. This Order may be cited as the Weymouth and Portland Harbour Revision Order 1993 and shall come into force on 8th April 1993.
2. In this Order-
"the Act of 1887" means the Weymouth and Melcombe Regis Corporation Act 1887(4);
"the added limits" means the area described in the Schedule to this Order;
"the Authority" means the Weymouth and Portland Borough Council.
3.-(1) The limits within which the Authority have jurisdiction in accordance with the Act of 1887 are hereby extended to include the added limits.
(2) All enactments conferring rights, powers, privileges or immunities or imposing duties, obligations or liabilities upon the Authority in relation to the harbour mentioned in the Act of 1887 or upon the harbour master for that harbour and all byelaws and regulations made by the Authority which immediately before the coming into force of this Order relate to or have effect within the said harbour shall relate to or have effect within the added limits.
(3) Section 8 of the Act of 1887 shall have effect as if after the words "the parish of Radipole" there were inserted the words "and shall include the added limits as defined in the Weymouth and Portland Harbour Revision Order 1993".

An area enclosed by a line drawn from a point on the shoreline at position 50deg 37.51'N 02deg 26.475'W to the north-east corner of the dockyard port of Portland (position 50deg 36.42'N 02deg 23.88'W) and thence in a 343.5 degrees (true) direction for 1.675 nautical miles to the shoreline (position 50deg 38.01'N 02deg 24.60'W).

This Order extends the limits within which the Weymouth and Portland Borough Council has jurisdiction by including a portion of Weymouth Bay from a point approximately 1.7 nautical miles east of the Nothe Fort to the borough boundary adjacent to Redcliffe Point, Weymouth as part of the harbour.
The applicant for the Order is the Borough Council of Weymouth and Portland.
