The Secretary of State, in exercise of the powers conferred on him by sections 4(1) and 59(2) of the Food Safety Act 1990((1)), and of all other powers enabling him in that behalf, hereby makes the following Order:-
1. This Order may be cited as the Milk (Special Designations) (Scotland) Amendment Order 1992, shall apply to Scotland only, and shall come into force on 21st August 1992.
2. The Milk (Special Designations) (Scotland) Order 1988((2)) shall have effect subject to the following amendments:-
(a)after article 2A(5) there shall be inserted the following paragraph:-
"(6) If any person contravenes or fails to comply with any of the provisions of this article he shall be guilty of an offence."; and
(b)after article 2B(3) there shall be inserted the following paragraph:-
"(4) If any person contravenes or fails to comply with any of the provisions of this article he shall be guilty of an offence.".

This Order which applies only to Scotland further amends the Milk (Special Designations) (Scotland) Order 1988 as previously amended by the Food Safety Act 1990 (Consequential Modifications) (Scotland) Order 1990. By virtue of article 22 of that Order, restrictions on the sale of milk without correct use of a special designation and on use of a special designation without a licence authorising such use, previously in the Milk (Special Designations) Act 1949 (c. 34), were inserted in the 1988 Order but the provision for offence(s) of breach of those restrictions was omitted. This Order inserts the offence provision.
