1. The new highways which the Secretary of State proposes to construct-
(a)along the route described in Schedule 1 to this Order (the highway along this route being in this Order referred to as "the main new trunk road"); and
(b)along the routes described in Schedule 2 to this Order which connect the main new trunk road with other highways at the places stated in that Schedule (the highways along these routes being in this Order referred to as "the slip roads"),shall become trunk roads as from the date when this Order comes into force.
2. The centre line of each of the new trunk roads is indicated by a heavy black line on the deposited plan.
3. The Secretary of State directs as respects any part of a highway which crosses the route of any of the new trunk roads that-
(a)where the highway is a highway maintainable at the public expense by a local highway authority, the part in question shall be maintained by that authority; and
(b)where the highway is not a highway so maintainable and is not maintainable under a special enactment or by reason of tenure, enclosure or prescription, the Secretary of State shall be under no duty to maintain the part in question,until, in either case, a date to be specified in a notice given by the Secretary of State to the highway authority for that highway. The date specified with not be later than the date on which the relevant route is opened for the purpose of through traffic.
4. In this Order-
(1) except where expressly otherwise provided, all measurements of distance are measured along the route of the relevant highway;
(2)(i)"the deposited plan"means the plan numbered HA10/EM69, marked "The A564 Trunk Road (Stoke-Derby Route) (Derby Southern Bypass and Slip Roads) (No 1) Order 1992", signed by authority of the Secretary of State and deposited at the Department of Transport, Romney House, 43 Marsham Street, London SW1P 3PY;
(ii)"the main new trunkroad" and "the sliproads" have the meanings given in article 1 of this Order;
(iii)"the new trunk roads"means the highways mentioned in article 1 of this Order;
(iv)"the A38 Trunk Road"means the A38 Exeter-Leeds Trunk Road; and
(v)"the A516 Trunk Road"means the A516 Nottingham-Stoke-on-Trent Trunk Road.
5. This Order shall come into force on 14th February 1992 and may be cited as the A564 Trunk Road (Stoke-Derby Route) (Derby Southern Bypass and Slip Roads) (No 1) Order 1992.

The route of the main new trunk road is in the parishes of Hilton, Etwall, Burnaston, Willington, Findern, Twyford and Stenson, Barrow-upon-Trent and Swarkestone in the District of South Derbyshire and Chellaston in the City of Derby, all in the county of Derbyshire.
The route is about 15.3 kilometres in length and starts from a point measured in a straight line on a horizontal plane 364 metres west by north of the junction of the A516 Trunk Road with Lucas Lane and Willowpit Lane (which point is marked `A' on the deposited plan). It then heads in a generally easterly direction crossing Egginton Road, Etwall, south of its junction with Jacksons Lane and over Etwall Common to cross Willington Road and the A38 Trunk Road at Willington. The route continues in a north-easterly direction to cross Heath Lane, the main Derby to Birmingham railway line and Sunny Hill Road, south of Stenson Fields and then sweeps south-eastwards to cross Arleston Lane and Deep Dale Lane, Barrow-upon-Trent south of Ashlea Farm, before continuing towards Swarkestone Lows to terminate at a point on the A514 (Swarkestone Road) measured in a straight line on a horizontal plane 150 metres south-west of the junction with that road and the southern boundary of the property known as "Windmill Cottage" (which point is marked "B" on the deposited plan).
Junction with the A516 Trunk Road, near Hilton
A route to connect the south east side of a roundabout to be constructed as part of the A516 Trunk Road (Derby Road) Hilton, north of its junction with Willowpit Lane and Lucas Lane, to connect with the eastbound carriageway of the main new trunk road. This route is given the reference number 1 on the deposited plan.
A route to connect the westbound carriageway of the main new trunk road with a roundabout to be constructed as part of the A516 Trunk Road south of the said junction. This route is given the reference number 2 on the deposited plan.
Junction with the A514 (Swarkestone Road), near Swarkestone
A roundabout, the centre of which is a point measured in a straight line on a horizontal plane 160 metres south-west of the junction of the A514 (Swarkestone Road) and the southern boundary of the property known as "Windmill Cottage". This route is given the reference number 3 on the deposited plan.
A route to connect the eastbound carriageway of the main new trunk road with the north west side of the route described at (b)(i) above. This route is given the reference number 4 on the deposited plan.
A route to connect the south west side of the route described at(b)(i) above with the westbound carriageway of the main new trunk road. This route is given the reference number 5 on the deposited plan.
