TERMS AND CONDITIONS OF EMPLOYMENT

Whereas-
(1) in pursuance of section 6(1), (2)(b) and (5) of the EmploymentProtection Act 1975(1) (hereinafter referred to as"the Act") the Advisory, Conciliation and Arbitration Service (hereinafterreferred to as"the Service") issued a Code of Practice on time off for trade union duties andactivities which came into effect on 1st April 1978;
(2) section 6(10) of the Act provides that the Service may from time totime revise the whole or any part of a Code of Practice issued underthat section and issue the revised Code, and that section 6(3) to (9)shall apply (with appropriate modifications) in relation to such arevised Code;
(3) in pursuance of section 6(3) and (10) of the Act the Service hasrevised the Code of Practice on time off for trade union duties andactivities, has published a draft of the revised Code of Practice andhas considered representations made to it about the draft;
(4) in pursuance of section 6(4) and (10) of the Act the Service hastransmitted the draft revised Code of Practice to the Secretary ofState, who has laid it before both Houses of Parliament;
(5) in pursuance of section 6(5) and (10) of the Act the draft revisedCode of Practice has been approved by resolution of each House ofParliament and the Service is issuing the revised Code of Practice inthe form of the draft;
Now, therefore, the Secretary of State, in exercise of the powerconferred on him by sections 6(5) and (10) and 123 of the Act(2), hereby makes the following Order:
1. This Order may be cited as the Employment Protection Code ofPractice (Time Off) Order 1991 and shall come into force on 13th May1991.
2. The revised Code of Practice on time off for trade union duties andactivities issued by the Service under section 6(5) and (10) of the Actshall come into effect on 13th May 1991.

This Order appoints 13th May 1991 as the day upon which the revisedCode of Practice on time off for trade union duties and activities whichis being issued by the Advisory, Conciliation and Arbitration Serviceunder section 6 of the Employment Protection Act 1975 will come intoeffect.
1975 c. 71; subsection (2) of section 6 was amended bythe Employment Protection (Consolidation) Act 1978 (c. 44), Schedule 16,paragraph 23(2), and subsection (10A) was inserted by the Employment Act1980 (c. 42), Schedule 1, paragraph 4.
Section 123 was amended by the Employment Protection(Consolidation) Act 1978 (c. 44), Schedule 17.
