In exercise of the powers conferred upon me by section 54(4) of, and paragraph 1 of Schedule 3 to, the Powers of Criminal Courts Act 1973(1) and after the consultation required by that paragraph, I hereby make the following Order:
1. This Order may be cited as the Combined Probation Areas (Cornwall) Order 1991 and shall come into force on 19th January 1991.
2. That part of Schedule 2 to the Combined Probation Areas Order 1986(2) which relates to Cornwall Probation Committee shall be amended by-
(a) omitting the entries in respect of the petty sessions areas of Dunheved, Falmouth and Penryn, Helston and Kerrier and Stratton; and
(b) inserting in alphabetical order in column 1-
(i)"Dunheved and Stratton" and corresponding to that in column 3 "1" ; and
(ii)"Falmouth and Kerrier" and corresponding to that in column 3 "2".
3. The two members of the Cornwall Probation Committee appointed before 1st January 1991 by the justices for the petty sessional divisions of Dunheved and Stratton shall decide by agreement, or in default of agreement by lot, which one of them shall continue in office as if appointed by the justices for the new petty sessional division of Dunheved adn Stratton.
4. The two members of the Cornwall Probation Committee appointed before 1st January 1991 by the justices for the petty sessional divisions of Falmouth and Penryn and Helston and Kerrier shall continue in office as if they had been appointed by the justices for the new petty sessional division of Falmouth and Kerrier.

This Order amends the Combined Probation Areas Order 1986 to take account of the re-organisation of petty sessional divisions in Cornwall effected by the Petty Sessional Divisions (Cornwall) Order 1990 (S.I. 1990/2099) which came into force on 1st January 1991.
S.I. 1986/1713, to which there are amendments not relevant to this Order.
