Whereas North West Water Limited holds an appointment under Chapter I of Part II of the Water Act 1989(1) as a water and sewerage undertaker ("the Company"):
And whereas the Company has, pursuant to section 162(6)(a) of that Act, submitted to the Secretary of State for his approval a Code of Practice(2) with respect to the exercise by the Company of powers conferred by or by virtue of paragraph 4 of Schedule 19 to that Act ("the Code of Practice"):
And whereas the Secretary of State considers it appropriate to approve the Code of Practice for the purpose of promoting what appear to him to be desirable practices with regard to the exercise by the Company of those powers:
Now, therefore, the Secretary of State, in exercise of the powers under section 162(7) of the Water Act 1989, and of all other powers enabling him in that behalf, after consulting all such persons as he considers it appropriate to consult, hereby makes the following Order:
1. This Order may be cited as the North West (Pipelaying and Other Works) (Code of Practice) Order 1991.
2. The Code of Practice prepared by the Company and certified as such by the Secretary of State is hereby approved.
