The Secretary of State for the Environment, in exercise of the powers conferred on him by sections 2(9) and 15(5) of the Local Government Act 1988(1), and of all other powers enabling him in that behalf, hereby makes the following Order:-“
1. This Order may be cited as the Local Government Act 1988 (Defined Activities) (Exemption) (England) (No. 2) Order 1991 and shall come into force on 22nd November 1991.
2. -“
(1) The management of the Richmondshire Swimming Pool by Richmondshire District Council shall not be treated as a defined activity in any financial year so long as educational institutions have used the pool exclusively in the immediately preceding financial year for more than 600 hours.
(2) In this article "educational institutions" has the same meaning as in paragraph 8(3) of Schedule 1 to the Local Government Act 1988(2).
3. The maintenance of ground by the council of the London borough of Hounslow shall not be treated as a defined activity so long as and in so far as it is undertaken in pursuance of an agreement in respect of the grounds of Chiswick House made between that council and the Historic Buildings and Monuments Commission for England on 26th February 1988.

(This note is not part of the Order)
Under Part I of the Local Government Act 1988 (Competition) work falling within certain defined activities may only be carried out by local authorities if particular conditions are fulfilled.
This Order exempts from the requirements of Part I the management by Richmondshire District Council of the Richmondshire Swimming Pool (article 2), and ground maintenance work carried by the council of the London Borough of Hounslow (article 3), so long as in each case a specified condition is met.
