The Secretary of State, in exercise of his powers under sections 4(1), 16(1)(c) and (f) and 48(1) of the Food Safety Act 1990(1), and of all other powers enabling him in that behalf, after consultation in accordance with section 48(4) and (5) of that Act with such organisations as appear to him to be representative of interests likely to be substantially affected by these Regulations, hereby makes the following Regulations:
1. These Regulations may be cited as the Cream (Heat Treatment) (Scotland) Amendment Regulations 1990 shall apply to Scotland only and shall come into force on 1st January 1991.
2. The Cream (Heat Treatment) (Scotland) Regulations 1983(2) shall be further amended by inserting in regulation 4(1) after the word "sell" the words "by retail".

These Regulations amend the Cream (Heat Treatment) (Scotland) Regulations 1983 by restricting the prohibition on the sale of cream unless it satisfies the heat treatment requirements specified in the principal Regulations to retail sales only.
